Padilla entitled to consult attorney. Really.

US District Judge Michael B. Mukasey, in a funny 37 page decision devoted mainly to rebuking the government lawyers for their tendentiousness, delaying tactics, and "arguments permeated with the pinched legalism one usually encounters with non-lawyers," concludes by saying in effect, "I said you have to let Jose Padilla see his attorney, now let him see his attorney."

I'm sure the government will appeal, and American citizen (and suspected terrorist) Jose Padilla will spend more time in jail without access to an attorney. He has spent 340 days there so far.
